What is a Division Order?

A Division Order is a communication tool that allows us to tell you what we believe you own and gives you the opportunity to confirm it or correct us. It also confirms we have your current contact information.

Do I have to sign the Division Order?

Yes, a signed Division Order is required prior to receiving royalty payments.

What is an Owner Number?

This is a unique number assigned to your account. Please provide it when contacting Tap Rock Resources as this will help us research your questions more quickly.

When are royalty payments issued?

Checks are mailed (or deposited if you've signed up for electronic deposit) the last business day of the month. Proceeds will accrue until the account reaches $50 or will be paid annually, whichever occurs first.

How do I change my address?

You can complete and sign our Address Change form or send a signed letter requesting the change. Email a copy to OwnerUpdate@taprk.com or mail to:

Address change requests must be signed by the owner.

How do I update my name?

Provide a copy of your Marriage Certificate, Divorce Decree* or other legal document affecting the name change.

*In the case of divorce, additional documents may be required. Please see below.

How do I update a company's name?

Provide a recorded copy of the Certificate of Merger or Name Change document.

Power of Attorney

  • Power of Attorney document (notarized)
  • Contact information for Attorney-in-Fact

Ownership Transfers

Please note all conveyances must be recorded in the County where the property is located. Be sure to keep your original and send a copy to Tap Rock.

Trust

  • Recorded Deed into the Trust
  • Certification of Trust or pages from the Trust document showing:
    • Trust name
    • Trustor(s)
    • Trustee(s)
    • Successor Trustee(s)
    • Beneficiary(ies)

Trustee Change

Document evidencing resignation of current Trustee and acceptance of role by new Trustee. This document should be notarized.

Sale to new owner

Recorded Deed or Conveyance showing the transfer of property

Divorce

  • Divorce Decree or Settlement Statement
  • Recorded Deed

Death

Individuals who owned New Mexico property:

If the deceased individual had a Will probated in New Mexico:

  • Death Certificate
  • Letters Testamentary or Letters of Administration (recorded)
  • Order Admitting the Will to Probate (recorded)
  • Final Decree issued by the Court (if applicable)
  • Personal Representative's Deed
  • Evidence stating all taxes related to the Estate have been paid

If the deceased individual had a Will and probate occurred in another state, New Mexico requires administration of the Estate.

If the deceased individual owned New Mexico properties and did not have a Will, New Mexico requires administration of the Estate.

Individuals who owned Texas property:

If the deceased individual had a Will probated in Texas:

  • Death Certificate
  • Letters Testamentary or Letters of Administration (recorded)
  • Order Admitting the Will to Probate (recorded)
  • Will (recorded)
  • Final Decree issued by the Court (if applicable)
  • Evidence stating all taxes related to the Estate have been paid

If the deceased individual had a Will and probate occurred in another state, Texas will recognize the proceeding.
